Any Lawyers here?

I am working in International School and I am thinking about breaking the contract. My contract will be finished by July 31st (next month) But the problem is I already renewed a new one with the school since February, 2012 which the new one will start in Aug 1st ,2012

so if i wanna leave the school with pay i must inform the school since end of last month but there's a cause that I can't tell the school that time ...

if I go tell them now .. they will just kick me out without pay (for next month) because now they have summer school and they assigned me to teach in session 1 (June) and I will take vacation in July (session 2 is in July) ...

in the contract said

'if The employee decides to resign, the resignation letter is require to submit at least sixty (60) days prior the effective date of resignation, and if the employee fails to do so, he/she must compensate for the school for the amount of his/her one month salary'

I know it's sound that I am not a good employee but the school cheated me first. Since the first day i went to had an interview with this school .... The owner promised to increase me salary during i m doing master and will increase more when i finish ... i work for this school for 4 years .. when i was doing my master for year 1 (i mean half way of doing master) ...i asked them about increasing salary ..they said let's talk bout this when you finish all the coursework ... 1 year later i asked them again about increasing salary .. they said .. ok let's talk bout this after you get the paper... that's why I start looking for a new job and want to leave the school.

my question is .. does this contract actually effect to me?

I'm not a lawyer, but I've been sued by many of them. I suggest that you get your paycheck and just leave.

However, a week before you leave...bring up the fact that they didn't fulfill their promise about raising your salary. Tell them that you are upset about it, and escalate it to the point that you might contact a lawyer about it.

When you leave, tell them that you won't contact a lawyer as long as you can leave without any problems on their end. Trust me, they won't want to deal with you over 1 month's salary if they think you're serious.

If you're honest and tell them beforehand, at bare minimum they will cut your salary by 50%. They know you're leaving and as sad as it sounds, they will care about 10,000 baht more than they care about you.

I've seen this happen before with Thai schools. Honesty is not the best policy here. Take the money and run.

thx Japamerican. I am also thinking about to get my money and leave. But I don't have any evidences that they will increase me salary ... it's just words ....

It's a verbal contract, but that doesn't even matter. As long as they see that you are somewhat serious about this, they won't waste their time to get your salary from you.

Secondly, this should teach you to get written contracts in the future no matter what. I just learned the same lesson last year...luckily I got what I deserved.

I used to work as a teacher in bilingual school as for thai people I personally dont think the contract will be that effect to you and nature of thai we dont like to have a problem I am pretty sure if you just leave they not gonna run after you and that what I did !! I agree with Japamerican just take your money and run!!
